On May 24, 2019, the Office for Civil Rights (OCR) at the U.S. Department of Health and Human Services (HHS) released the “Nondiscrimination in Health and Health Education Programs or Activities” notice of proposed rulemaking. HHS proposes a number of changes that would radically reinterpret civil rights protections under the Health Care Rights Law (Section 1557 of the Affordable Care Act) for persons who are limited English proficient (LEP). These include changing who must comply with the law, limiting enforcement of civil rights, and rolling back protections. This fact sheet reviews these proposals and their potential impact.
